FireBoard Labs, LLC (“FireBoard”) respects your privacy and understands the importance of privacy to our users. FireBoard developed this Privacy Policy (the “Policy”) to explain how FireBoard collects, uses, shares, and protects Personal Information (defined below).This Policy applies to Personal Information collected on our website, collected by our products and services, and any other application (mobile or not) from which this Policy is linked (collectively, the “Services”).

1. What is Personal Information?
“Personal Information” is information that, either alone or in combination with other information, identifies or relates to a particular individual. Examples of Personal Information include, among others, name, email address, phone number, mailing address, banking information, test information, and online identifiers.
Types of Personal Information FireBoard Collects and Uses
A. Personal Information that you provide FireBoard
To provide you the Services, in various places within the Services, FireBoard may request you provide FireBoard certain Personal Information. FireBoard does not collect any Personal Information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs.
For example, when you choose to create an account or use the Services, you may provide certain Personal Information, including, but not limited to:
- Name;
- Username;
- Cell phone number;
- Email address;
- Date of birth;
- Your image and/or likeness;
- Geolocation;
- Sensor data (e.g. temperature readings, the humidity in your area, etc.) and
- Login information associated with your Gmail account or social media accounts that you use to connect to the Services (this could include, for example, your Facebook or Instagram account).
FireBoard will indicate on the form whether a particular field of Personal Information is mandatory or optional. If you choose not to provide certain Personal Information, FireBoard may not be able to provide the requested Services.
B. Personal Information FireBoard Automatically Collects from You
FireBoard collects the following types of Personal Information automatically through your use of the Services:
- Cookies, Device Identifiers, and Similar technologies
Cookies are small data files that are transferred to your computer’s hard disk and are used to store information about website visits, your preferences, and enhances website functionality. To improve your overall experience with the Services, we may use cookies, device identifiers, and similar technologies such as pixels, web beacons, and local storage for the following purposes: to improve the functionality of the Services, to remember your online preferences within the Services, and to help us better understand how you interact with the Services.
Most browsers provide you with the ability to block, delete, or disable cookies, and your mobile device may allow you to disable transmission of unique identifiers and location data. If you choose to reject cookies or block device identifiers, some features of the Services may not be available, or some functionality may be limited or unavailable. Some of our service providers may use cookies or other methods to gather information regarding your use of the Services, and may combine the information in these cookies with any Personal Information about you that they may have. - Google Analytics
To assist us with analyzing the traffic to the Services through cookies or similar technologies, FireBoard may use analytics Services, including Google Analytics. - Advertising
FireBoard may engage third parties, including social media platforms, who may use cookies, pixel tags, and other storage technologies to collect or receive information from the Services or elsewhere on the internet to provide marketing Services to FireBoard, including targeted advertising. If you want to learn more, including how you may opt-out of targeted advertising, you should visit the following sites: https://www.aboutads.info/choices/, https://www.networkadvertising.org, https://www.youradchoices.com (please note: FireBoard does not operate or control these third party sites, and there may be additional ways for you to opt out of online advertising). Please note that by opting out, you will continue to see ads, but the ads may not be as relevant to your interests.
- Geolocation Information
To improve the accuracy of the Services, FireBoard may track your location-based information from your mobile device, either continuously or while you are using the Services. If you wish to change FireBoard’s access or permissions, you may be able to do so in your mobile device’s settings menu.
- Log File Information
When you use the Services, FireBoard’s servers automatically record information, including your Internet Protocol address (“IP Address”), browser type, referring URLs (e.g., the Services you visited before coming to the Services), domain names associated with your internet service provider, information on your interaction with the Services, and other such information (collectively, “Log File Information”). FireBoard may also collect similar information from emails sent to you which then help FireBoard track which emails are opened and which links are clicked by recipients.
2. How FireBoard Uses Personal Information
FireBoard uses or in the future may potentially use Personal Information for the following purposes:
- Offering the Services to you;
- Administering and improving the Services;
- Enabling secure use of the Services;
- Sending you information and promotional materials;
- Promoting FireBoard’s Services and brand;
- Protecting FireBoard’s rights and intellectual property;
- Meeting legal obligations; and
- For other purposes related to the reasons for which you provide Personal Information.
FireBoard will retain your Personal Information only as long as necessary to fulfill the purposes for which FireBoard collected and processed the Personal Information, or as required by applicable laws.
3. Disclosure of Personal Information
FireBoard will not disclose Personal Information except as set forth in this Policy. This Section describes to whom FireBoard discloses Personal Information and for what purposes:
- Service Providers. FireBoard engages service providers to perform tasks on its behalf and to assist in operating the Services. For example, FireBoard may use third-party service providers to provide the necessary hardware, software, networking, storage, and related technology required to operate the Services. FireBoard takes commercially reasonable steps to help ensure its service providers provide at least the same level of protection for Personal Information as FireBoard does.
- Companies Involved in Mergers and Acquisitions Transactions. If FireBoard sells or otherwise transfers part or the whole of its business or assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, or liquidation), any Personal Information collected through the Services may be among the items sold or transferred.
- Law Enforcement, Government Agencies, and Courts. FireBoard may disclose Personal Information at the request of law enforcement or government agencies; in response to subpoenas, court orders, or other legal process; to establish, protect, or exercise FireBoard’s rights; to defend against a legal claim; to protect the rights, property, or safety of any other person; or as otherwise required by law.
4. How FireBoard Protects Personal Information
In accordance with industry standards, FireBoard uses administrative, technical, and physical security measures to help protect your Personal Information under FireBoard’s control. However, while FireBoard attempts to ensure the integrity and security of Personal Information, FireBoard cannot guarantee that its security measures will prevent third parties such as hackers from illegally obtaining access to Personal Information. FireBoard does not represent or warrant that Personal Information about you will be protected against, loss, misuse, or alteration by third parties.
As discussed above, FireBoard keeps your Personal Information only as long as necessary to fulfill the purposes for which it was collected and processed, including for the purposes of satisfying any legal, regulatory, accounting or reporting requirements. In some circumstances, FireBoard may de-identify, aggregate, or otherwise anonymize your Personal Information consistent with applicable laws and industry standards so that it can no longer be associated with you, in which case it is no longer treated as Personal Information.
6. Accessing, Updating, or Deleting Personal Information
If you would like to otherwise access, update, or delete Personal Information about you, you may submit a request to FireBoard by using the contact information in Section 13 (How to Contact FireBoard) below.
7. Opting Out of Receiving Electronic Communications
To provide you information regarding the Services, FireBoard may send you newsletters, marketing materials, surveys, or other information via email, text, or other electronic method (“Communications”). You may choose to stop receiving Communications by clicking on the conspicuous “Unsubscribe” link located at the bottom of any Communication FireBoard sends to you. Please note that certain Communications are necessary for the proper functioning and use of the Services and you may not have the ability to opt out of those Communications.
8. International Use of the Services
If you use the Services outside the United States, please be aware that Personal Information may be collected, stored, and processed in the United States. FireBoard will not transfer Personal Information internationally. Please be aware that the data protection laws of the United States might not be as comprehensive as those in your country.
9. Must be Sixteen (16) years old to Use the Services
The Services is intended to be used solely by individuals sixteen (16) years of age or older. FireBoard does not knowingly collect or solicit Personal Information from minors under the age of sixteen (16). In the event that FireBoard learns that FireBoard has collected Personal Information from a minor under the age of sixteen (16), FireBoard will promptly take steps to delete that information.
FireBoard is not responsible for the practices employed by any websites or Services linked to or from the Services, including the information or content contained within them. A link to a third party’s websites should not be construed as an endorsement. FireBoard encourages you to investigate and ask questions before disclosing Personal Information to third parties.
If you post a photo or video of your use of the Services, you hereby irrevocably and perpetually grant to Fireboard, and our designees a worldwide license to use, publish, reproduce, create derivative works of, distribute, and publicly display the photo or video in any form, media, or content which now or hereafter exists, for advertising, promotional, or any other commercial purposes as well as non-commercial purposes. YOU AGREE THAT FIREBOARD SHALL HAVE THE RIGHT TO USE THE VIDEO AND/OR PICTURE EVEN IF IT CONTAINS YOUR LIKENESS OR THE LIKENESS OF OTHERS. You waive any compensation for any use of such photo or video. You hereby release and waive any claims, demands, damages, losses, liabilities, and causes of action arising from Fireboard’s uses of the photo or video, including, without limitation, any claims for defamation, libel, invasion of privacy, publicity, personality, or exploitation of your name or likeness. You represent and warrant that if the photo or video contains the image or likeness of a third party, you have obtained that third party’s consent to grant this license and that the photo or video does not contain the image or likeness of any minor child.
FireBoard may modify or update this Policy from time to time, so please review it periodically. If FireBoard makes a change to this Policy that, in its sole discretion, is material, FireBoard will notify you as appropriate under the circumstances. Unless otherwise indicated, any changes to this Policy will apply immediately upon posting to the Services.
